Red Flag 8

One of the most reported types of identity theft is from victims who have been questioned, detained or arrested for committing a crime they have not committed.  It’s called criminal or character identity theft.

How does it work?  A wanted criminal uses your identity to evade identification and to avoid arrest.  For example, two-gun Crowley gets pulled over in a routine traffic stop and provides forged identification with your personal information and his picture.  They let him go, because he’s you, and he’s not himself.

Let’s say that “Two Gun Crowley” gets caught committing a crime.  He uses your identification when he’s arrested. Since you have a clean record, he has a clean record.  He booked, and let go on bail.  Does he show up for his court date?  Not a chance. But the court records show that you didn’t show up, so a warrant is issued for your arrest.

Now you are pulled over in a routine traffic stop, and son-of-a-gun; you’re arrested.  Officer it isn’t me.  He’s heard that a thousand times.

There are hundreds of stories of innocent victims throughout the country who have been arrested for everything from prostitution to murder.  People lose their jobs because a felony suddenly shows up on their record.  Now you can’t a job anywhere because you have a criminal record.   One man recently spent two months in jail as a victim of character identity theft, an executive for an international corporation was arrested for not showing in court for DWI charges.

What would you do if you were arrested in the middle of the night, or jailed indefinitely.  How would you go about trying to expunge criminal charges from your character identity?

Wouldn’t it be useful to have 24/7 access to an attorney nationwide if you were arrested or detained?  It takes the expertise of specialized attorney to clear those court records.  Where would you get these resources on a Saturday night?
